How AI is used
From the amounts, the dates the lawyer supplies, and any agreed rate, record the rate and the start date. Do not choose a rate.
What the lawyer must review
You choose any rate the arbitrator is asked to use. Rule R-49(d) says the award may include interest at such rate and from such date as the arbitrator may deem appropriate, and attorneys' fees if all parties have requested them or they are authorized by law or the arbitration agreement. The opened rule does not pick a rate. Confirmation is a different step. 9 U.S.C. § 9 says that if the agreement provides that a judgment shall be entered upon the award and specifies the court, then within one year after the award any party may apply to that court for an order confirming it, and the court must grant the order unless the award is vacated, modified, or corrected under sections 10 and 11. If no court is specified, the application may be made to the United States court for the district within which the award was made. Notice must be served on the adverse party. Confirmation does not set the interest rate in the award.
