- How AI is used
- From the agreements and the filing dates the lawyer supplies, list whether every party consents, whether an arbitrator is already appointed, the date the filing requirements were satisfied, and which of the stated factors the request would ask the arbitrator to consider. Do not write the request and do not decide that joinder or consolidation should be ordered.
- What the lawyer must review
- You decide whether to request joinder or consolidation, and you write the request. Where the parties have provided for these Commercial Arbitration Rules, Rule R-1(a) makes the rules part of the agreement in the form in effect when the administrative requirements for the demand are met, and 9 U.S.C. § 2 is why that written agreement is enforceable. Section 2 does not itself authorize joinder or consolidation. Rule R-8(a) allows consolidation if all parties to all of the arbitrations agree. Absent that agreement, a written request with reasons must be filed with the AAA and served within 90 days of the date the AAA determines that the administrative filing requirements were satisfied for the last-filed case, unless the arbitrator in the first-filed case extends the time for good cause. Responses are due within 10 calendar days after the AAA sends notice of receipt. The AAA may direct the first-filed arbitrator to decide, or appoint a consolidation arbitrator for that decision only. The factors in R-8(a)(vi) are the terms and compatibility of the agreements, applicable law, timeliness and progress, common issues of law or fact, and the interests of justice and efficiency. Rule R-8(b) allows joinder if all existing parties and the parties proposed to be joined agree. Absent consent, the request must be made before the arbitrator is appointed or within 90 days after the AAA determines that the filing requirements were satisfied, unless the arbitrator extends the time for good cause. If there is no agreement, the arbitrator decides. The written request must give names and contact details, representatives if known, and reasons including applicable law, and it must be copied to the existing parties and the parties sought to be joined. Their responses are due within 14 days after the AAA sends notice of receipt. The requesting party must also comply with Rule R-4(a) as to the parties sought to be joined.
