Draft the notice of arbitration or the response from the contract and the facts brief
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the arbitration clause and the facts brief, list the parties, the seat or place if the clause names one, the institution, the claims and the relief asked, with each fact tied to a document. The lawyer writes the notice.
- What the lawyer must review
- A written arbitration agreement in a maritime transaction or a contract evidencing a transaction involving commerce is valid, irrevocable and enforceable, save on grounds that exist for revocation of any contract, or as chapter 4 otherwise provides (9 U.S.C. § 2). The notice itself is served under the clause and the institutional rules, not under the Federal Rules of Civil Procedure. Formal Opinion 512 and Rule 11 matter if the same text is later filed in court, including on a motion to compel or to confirm. The lawyer checks every citation before the notice goes out.
