How AI is used
From the procedural history, list the rule the party knew had not been complied with, and whether the party then went on with the arbitration without stating an objection in writing. Do not decide that the right to object was lost.
What the lawyer must review
You decide whether Rule R-42 applies to the step on the file. Rule R-42 says that any party who proceeds with the arbitration after knowledge that any provision or requirement of these Rules has not been complied with, and who fails to state an objection in writing, shall be deemed to have waived the right to object. The opened sentence is about a provision or requirement of these Rules. It does not say that going on waives every objection to a term of the arbitration agreement. 9 U.S.C. § 2 makes a written agreement adopting the rules enforceable. It is not itself a waiver rule. Rule R-54(a) is a different point: no judicial proceeding by a party relating to the subject matter of the arbitration shall be deemed a waiver of the right to arbitrate.
