- Executive Order 12600 tells an agency, to the extent permitted by law, to notify a submitter of confidential commercial information when it determines it may be required to disclose the records under 5 U.S.C. § 552. The order defines that information as records that arguably contain material exempt under Exemption 4 because disclosure could reasonably be expected to cause substantial competitive harm. Exemption 4 in the statute is trade secrets and commercial or financial information obtained from a person and privileged or confidential. Section 4 of the order gives the submitter a reasonable period to object. It states no number of days. Section 9 also requires notice to the requester. Section 10 says the order creates no right enforceable at law. You write both notices.
