- List the person, the matter, and whether the file says another lawyer represents that person in the matter. Do not send the communication and do not say it is permitted.
- What the lawyer must review
- You decide whether the contact may be made. Model Rule 4.2 says that, in representing a client, a lawyer shall not communicate about the subject of the representation with a person the lawyer knows to be represented by another lawyer in the matter, unless the lawyer has the consent of the other lawyer or is authorized to do so by law or a court order. The comments to Rule 4.2 were not opened, so this check does not state a rule about employees or former employees of an organization. Model Rule 1.6 still limits what you reveal while you compare the two files. Formal Opinion 512 requires informed consent before information relating to the representation goes into a self-learning tool. You write any message that is sent.
