List former-client facts before any screen is treated as enough
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the former client, the new matter in the file's words, and whether a written screen notice is already on the file. Do not say the firm may act.
- What the lawyer must review
- You decide the conflict. Rule 1.10(a) says that while lawyers are associated in a firm, none of them shall knowingly represent a client when any one of them practicing alone would be prohibited by Rule 1.7 or Rule 1.9, unless a stated exception applies. The screen in Rule 1.10(a)(2) is for a prohibition based on Rule 1.9(a) or (b) that arises from the disqualified lawyer's association with a prior firm. It requires a timely screen, no part of the fee, written notice to the former client with the contents the rule lists, and certifications. It is not a cure for a Rule 1.7 conflict. The text of Rules 1.7 and 1.9 was not opened, so you open them before you decide the prohibition exists. Rule 1.10(c) says a disqualification under this rule may be waived by the affected client under the conditions stated in Rule 1.7. Those conditions were not opened. A notice that is not in the file is not described as sent.
