List both current clients before any decision that the firm may act
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each current client and the matter the file uses for that client. Do not say the firm may act for both and do not propose a screen.
- What the lawyer must review
- You decide the conflict. Rule 1.10(a) says that while lawyers are associated in a firm, none shall knowingly represent a client when any one of them practicing alone would be prohibited by Rule 1.7 or Rule 1.9, unless an exception in the rule applies. The screen in Rule 1.10(a)(2) is only for a prohibition based on Rule 1.9(a) or (b) arising from a prior firm. It is not a cure for a Rule 1.7 conflict between two current clients. The text of Rule 1.7 was not opened. You open it before you decide whether a prohibition exists. Rule 1.10(c) points a waiver to the conditions in Rule 1.7, which were not opened. Model Rule 1.6 limits what you reveal while you compare the two matters.
