List the lawyer's own interest the file describes
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the personal interest the intake note describes, and which lawyers would remain on the matter. Do not say the interest is harmless and do not say the firm is clear.
- What the lawyer must review
- You decide. Rule 1.10(a) imputes a prohibition under Rule 1.7 or Rule 1.9. One exception, in Rule 1.10(a)(1), is a prohibition based on a personal interest of the disqualified lawyer that does not present a significant risk of materially limiting the representation of the client by the remaining lawyers. The tool does not decide that risk. The text of Rule 1.7 was not opened, so you open it before you decide that a personal-interest prohibition exists at all. Model Rule 1.4(b) is the explanation the client needs. Formal Opinion 512 applies before the intake note goes into a tool.
