List a request to amend protected health information, without writing the answer
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the record the request names, the change it asks for, and the date the request was received. Do not write an amendment or a denial, and do not say the record must be changed.
- What the lawyer must review
- You decide the response. If the holder is a covered entity and the information is protected health information in a designated record set, 45 CFR § 164.526(a)(1) gives the individual a right to have it amended for as long as it is maintained there. Section 164.526(a)(2) allows a denial only if the information was not created by the covered entity, unless the originator is no longer available, or it is not part of the designated record set, or it would not be available for inspection under § 164.524, or it is accurate and complete. The covered entity must act no later than 60 days after receipt. One extension of no more than 30 days is allowed if, within the original time, it gives a written statement of the reasons for the delay and the date it will finish. No statute giving a right to correct personal information that is not protected health information was opened. Section 164.502 still limits use of the record. You write anything that is sent.
