- List each safeguard the written plan names, in the plan's words. Do not say the safeguards are reasonable and do not add one the plan does not describe.
- What the lawyer must review
- You decide whether the efforts are reasonable. Model Rule 1.6(c) says a lawyer shall make reasonable efforts to prevent the inadvertent or unauthorized disclosure of, or unauthorized access to, information relating to the representation. The rule does not list particular safeguards. Comment 8 to Rule 1.1 includes the benefits and risks of relevant technology. Formal Opinion 512 requires independent verification before you rely on a tool's description of a control. If the information is protected health information, 45 CFR § 164.502(a) still limits use and disclosure. No security-rule section was opened, so do not cite one.
