Build a document schedule the lawyer will mark for privilege
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each document by date, author, and type. Leave the privilege column blank. Do not say a document is privileged.
- What the lawyer must review
- You mark privilege. No privilege or work-product rule was opened, so the schedule does not apply a test and does not guess a label. Model Rule 1.6(a) still limits revelation of information relating to the representation while the schedule is built. Formal Opinion 512 requires informed consent before the documents go into a self-learning tool whose output could disclose that information. Model Rule 3.3 applies if you later describe the schedule to a tribunal. A document that is not in the set you marked is not added.
