Keep a supervision record for work a generative tool produced
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the file, enter the tool, the piece of work, the person who checked it, and the date. Do not mark the work as checked unless the file already records a check.
- What the lawyer must review
- Model Rule 5.3 requires reasonable efforts so that lawyers and nonlawyers who use the tool conform to the professional obligations. Formal Opinion 512 says managerial lawyers set the firm's rules for use, supervisory lawyers arrange training, and one suggestion in the opinion is to mark tool output in the file so a later reader knows it may be fallible. The lawyer decides the level of review. The opinion says the lawyer remains fully responsible for the work.
