Notify a consumer before a high-risk system makes a consequential decision
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the deployment record, list the decision, the date the system is to be used, and whether a notice to the consumer is already on the file. Do not send the notice.
- What the lawyer must review
- Section 6-1-1703(4)(a) requires the deployer, on and after 1 February 2026, and no later than the time the system is deployed to make or be a substantial factor in making a consequential decision, to notify the consumer before the decision is made, to give the statement the subsection describes, and, if applicable, to give the opt-out information that subsection points to. The lawyer decides whether the system is being used for a consequential decision and settles the notice. Section 6-1-1306, which the opt-out cross-reference cites, was not opened.
