How to use AI for NCAT and tribunal applications in Australia

NCAT is not the Supreme Court. Procedural Direction 7 is the tribunal’s generative AI direction. Where a generative tool was used, the direction’s verification statement is part of the lodgment.

Steps

  1. Read NCAT Procedural Direction 7

Where generative AI was used to prepare written submissions or a summary of argument, Procedural Direction 7 requires a verification in the body of that document: the citations and authorities exist, are accurate and are relevant, and the references to evidence are checked the same way. That check must not be done only with a generative tool. The direction also restricts generated content in statements, affidavits and similar evidence. It is not a different form for each division. Open the current direction on NCAT’s site before you lodge. This site’s NCAT page is a reminder, not the direction.

  2. Check every reference

Open each case and section the document cites. A reference that does not open is removed. The Queensland courts’ non-lawyer guidelines, also linked here, are a useful warning about invented cases. They are not NCAT’s rule. Use them as a caution, and use PD 7 as the direction.

Questions

Is it allowed to use AI for NCAT and tribunal applications in Australia?

NCAT’s Procedural Direction 7 allows some uses and restricts others. Written submissions prepared with generative AI need the verification in the body of the document. Generated content in affidavits and statements is restricted. Other tribunals have their own directions. Open the one named on the file.

What tools are used for NCAT and tribunal applications?

This page does not approve a tribunal product. The obligation is the verification statement and the check of references, not a brand of tool.

Can I reuse the Supreme Court’s affidavit disclosure in NCAT?

Only if Procedural Direction 7 asks for that disclosure. The tribunal’s form is the one to complete.
