Is it allowed to use AI for discovery and document review in Australia?
Yes, as technology-assisted review under a method the lawyers can explain. Privilege decisions are not delegated to the score.
Guide
Technology-assisted review of a discovery set is a method you agree, sample and write down. Privilege calls stay with lawyers.
Technology-assisted review is usually the subject of a protocol: the collection, the model, the seed set and what “relevant” means. Do not switch a production to a new model mid-review without telling the people the protocol binds. GPN-AI is the Federal Court note if that is the forum.
A person reviews a sample of what the tool included and a sample of what it excluded. Record the sample size and the error rate you will accept. A dashboard score is not that sample. The Law Society of New South Wales guide expects you to understand the limit of the tool you are relying on.
Privilege, without-prejudice markings and client confidential material are not a relevance score. A lawyer reviews those calls. Queensland Guidance Statement No. 37’s questions about storage and reuse matter before the set is uploaded to a vendor.
Keep the protocol, the tool and version, the sample results and the privilege procedure on the file. If the Court asks how the production was made, the note should answer. The Uniform Law regulators’ statement keeps responsibility with the solicitors, not with the vendor.

No. It sets expectations for the use of generative AI in Federal Court work, including what you put in documents you file. The review protocol is still yours to justify.
