Prepare the papers for a trustee decision without writing the resolution
Key facts

- YellowClose supervision
- How AI is used
- Turn the proposed decision into an agenda: the decision, the deed clause, who must approve, and the papers attached. Do not produce the resolution that will be signed.
- What the lawyer must review
- On acceptance, Uniform Trust Code § 801 says the trustee administers the trust in good faith, in accordance with its terms and purposes and the interests of the beneficiaries, and in accordance with the Code. Section 802(a) requires administration solely in the interests of the beneficiaries. A conflict transaction is voidable by an affected beneficiary unless one of the exceptions in § 802(b) applies, including authorisation in the terms of the trust or approval by the court. The Code is a model. It is not the law of a state until that state enacts it, and the deed controls where it speaks. You write the resolution. Opinion 512: do not put the deed into a public tool.
