- Table each distribution and minute the file contains: date, amount, recipient and the page it came from. Do not propose a further distribution.
- What the lawyer must review
- The history is what the records say. If the trust is ending, Uniform Trust Code § 817, where enacted, lets the trustee send a proposal for distribution. A beneficiary's objection right ends 30 days after the proposal was sent only if the proposal told the beneficiary of the right to object and of the time allowed. The trustee then distributes expeditiously, and may keep a reasonable reserve for debts, expenses and taxes. A release is invalid to the extent it was induced by improper conduct or the beneficiary did not know of the beneficiary's rights or of the material facts. Opinion 512: check the table against the minutes. The table is not a new resolution.
