How AI is used
List any termination or vesting date and distribution direction written in the deed, the settlor, each beneficiary the deed names, who has consented on the file, and whether the deed has a spendthrift clause. Do not decide that the trust has ended.
What the lawyer must review
Read the deed's own termination or vesting clause first. Do not supply a perpetuities period. None was opened. Uniform Trust Code § 411, where enacted, lets a noncharitable irrevocable trust be modified or terminated on the consent of the settlor and all beneficiaries, even if that is inconsistent with a material purpose. All beneficiaries may terminate without the settlor if the court concludes continuance is not necessary to achieve any material purpose, and may modify if the court concludes the change is not inconsistent with a material purpose. A spendthrift clause is not presumed to be a material purpose. On termination the trustee distributes as the beneficiaries agree. If not all consent, the court may still approve where the trust could have been changed had all consented and a non-consenting beneficiary's interest will be adequately protected. An agent's consent for the settlor needs express authority in the power of attorney or the terms. You decide whether the state has enacted the section.
