Compare two plan documents proposed for a transfer of benefits
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Line up the benefit, vesting and distribution clauses of the two documents. Do not decide that a transfer is allowed.
- What the lawyer must review
- The comparison shows differences. It does not decide them. ERISA § 404 requires the fiduciary to follow the plan documents insofar as they are consistent with ERISA, and § 1022 requires a summary a participant can understand. No anti-cutback statute was opened, so do not say whether a smaller benefit is forbidden. Opinion 512: check a sample of rows against both documents. You decide whether the transfer can be made.
