Review a work capacity decision against the capacity evidence

How AI is used
From the insurer's work capacity decision and the certificates and vocational material the lawyer supplies, table the insurer's finding on pre-injury employment and on suitable employment against each certificate and report. Do not write a review request or a dispute application.
What the lawyer must review
The lawyer decides whether the decision is supported and whether to seek review. SIRA says the insurer assesses functional, vocational and medical status and decides whether the worker can return to pre-injury employment or to suitable employment. If some capacity is found, weekly payments may be reduced or stopped based on what the worker could earn in suitable employment. These decisions can be reviewed or disputed. Work capacity assessments are not conducted for paid first responders.

Checklist

  1. Match each capacity finding to the certificate or report dated closest to the decision.
  2. Confirm the worker is not a paid first responder before treating a work capacity assessment as available.
  3. The lawyer writes any review request. Do not paste the comparison into it without that review.
