How AI is used
Using only the net-asset figure, the year the fund was established, and the lawyer's statement of whether expenses are paid from the fund, apply the public ancillary fund minimum published by the ATO. Each financial year the fund must distribute at least 4 per cent of the market value of its net assets at the end of the previous financial year. A fund in its first four years of operation is not required to distribute. If the 4 per cent is less than $8,800 and any expenses of that year are paid directly or indirectly from the fund's assets or income, the fund must distribute at least $8,800, or the remainder of the fund if it is worth less. A distribution includes money, property or benefits. Show the arithmetic. Do not apply a private ancillary fund rate.
What the lawyer must review
The lawyer confirms the three inputs, that the fund is a public ancillary fund, and whether to apply to reduce the minimum. Trustees and directors of trustees are jointly and severally liable for an administrative penalty for the guidelines, and the penalty cannot be paid or reimbursed from the fund.

Checklist

  1. Use the market value of net assets at the end of the previous financial year, as supplied by the lawyer.
  2. Apply the four-year establishment exception and the $8,800 floor only on the inputs the lawyer has marked.
  3. Do not use a private ancillary fund percentage. Those guidelines were not opened. Confirm any reduction application separately.
