How AI is used
Record the issue date printed on the Office action and the deadline the action itself sets. Record whether the action says the application is under section 1, section 44, or section 66(a) of the Act, if the action says so. Do not calculate a new date.
What the lawyer must review
Section 2.62(a) says each Office action shall set forth the deadline for response. Unless the applicant is notified otherwise, the response period is three months from the issue date for an Office action in an application under section 1 and/or section 44 of the Act, and six months from the issue date for an Office action in an application under section 66(a) of the Act. Unless the applicant is notified otherwise, the time in paragraph (a)(1)(i) may be extended by three months, up to a maximum of six months from the Office action issue date, upon timely request and payment of the fee in section 2.6(a)(28). That fee section was not opened, so you do not state a dollar amount. To be timely, the request must be received on or before the deadline set forth in the Office action. Paragraph (b) requires the response to be signed by the applicant, someone with legal authority to bind the applicant, or a practitioner qualified under section 11.14, in accordance with section 2.193(e)(2). Those two sections were not opened. Responses and extension requests must be submitted through TEAS. Email or facsimile is not accorded a date of receipt. You decide which period applies. Section 1063 is the opposition period. It is not this response period.
