How AI is used
From the references the lawyer supplies, fill a list with the identifiers in 37 CFR § 1.98(b): for a U.S. patent, inventor, patent number and issue date; for a U.S. patent application publication, applicant, publication number and publication date; for another publication, publisher, author if any, title, relevant pages, date and place of publication. Leave a blank where the reference does not show the item. Do not decide materiality.
What the lawyer must review
37 CFR § 1.56 is the duty to disclose information material to patentability. Section 1.98(a) requires an information disclosure statement filed under § 1.97 to include the items in paragraphs (a)(1) through (a)(4). The list in (a)(1) separates U.S. patents and U.S. patent application publications from other documents, and each page includes the application number, a column for the examiner's initials, and a heading that the list is an information disclosure statement. Paragraph (a)(2) is the copy requirement, (a)(3) covers a concise explanation and any translation of a non-English document, and (a)(4) is the size-fee assertion. You choose what is material, you gather the copies, and you sign the statement.
