Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the mark, any registration number printed in the file, the owner's place of organization if the file states it, and whether a certificate of registration is in the file. Write no filing.
- What the lawyer must review
- You decide whether to lodge the notice. 19 U.S.C. § 1526(a), except as subsection (d) provides, makes it unlawful to import into the United States any merchandise of foreign manufacture if the merchandise, or the label, sign, print, package, wrapper, or receptacle, bears a trademark owned by a citizen of the United States, or by a corporation or association created or organized in the United States, and registered in the Patent and Trademark Office by a person domiciled in the United States, under the provisions of sections 81 to 109 of title 15, and if a copy of the certificate of registration is filed with the Secretary of the Treasury in the manner provided in section 106 of title 15, unless written consent of the owner is produced at the time of making entry. Those title 15 cross-references are the statute's own words. Do not replace them with a section you have not opened. The recordation practice, including any form and any fee, is not stated in § 1526(a). Confirm the current Treasury rule before a notice is lodged. 15 U.S.C. § 1114(1)(a) is a civil action for use of a registered mark. It is not this recordation.
