List the opposed mark, the goods or services named in the application, the publication date the lawyer supplies, and each exhibit with its date and page. State no ground and compute no deadline. Write no sentence of the opposition.
What the lawyer must review
15 U.S.C. § 1063 allows a person who believes he would be damaged by registration of a mark on the principal register, including by dilution by blurring or tarnishment under § 1125(c), to file an opposition on payment of the prescribed fee, stating the grounds, within thirty days after publication under § 1062(a). A written request made before those thirty days expire extends the time for an additional thirty days, and the Director may grant further extensions for good cause when requested before the extension expires. The Director notifies the applicant of each extension. Section 1052(d) bars registration of a mark that so resembles a registered mark, or a mark or trade name previously used in the United States by another and not abandoned, as to be likely, when used on or in connection with the goods of the applicant, to cause confusion, or to cause mistake, or to deceive. You decide whether to oppose, on what ground, and which exhibits support it.
