How AI is used
List each suggested name, the goods the client named, and a blank column for the § 1052 bar the lawyer is considering. State no bar and no clearance.
What the lawyer must review
15 U.S.C. § 1052 sets the bars to the principal register, including § 1052(d): a mark that so resembles a registered mark, or a mark or trade name previously used in the United States by another and not abandoned, as to be likely, when used on or in connection with the applicant's goods, to cause confusion, mistake or deception. You read the rest of § 1052, including subsections (a), (b), (c), (e) and (f), before you clear a name. A name a tool suggested has no special status. You still search and you still decide.
