- What the lawyer must review
- Section 45(a)(1) of Title 15 declares unfair methods of competition in or affecting commerce, and unfair or deceptive acts or practices in or affecting commerce, unlawful. Section 45(a)(2) empowers the Commission to prevent persons, partnerships, or corporations from using them, with exceptions that include banks. This statute is not a general unfair-contract-terms test, and it is not applied as one. No state franchise-relationship statute was opened. Section 436.10(b) says a state law that affords equal or greater protection, such as registration of disclosure documents or more extensive disclosures, is not inconsistent with Part 436. The lawyer decides whether any law reaches the clause.
