List the rates and jobs stated in the file and any sentence that says who employs the workers. Do not decide that a franchisor employs a franchisee's workers and do not call a clause a wage breach.
What the lawyer must review
29 U.S.C. section 206(a) says every employer shall pay each of his employees who in any workweek is engaged in commerce or in the production of goods for commerce, or is employed in an enterprise engaged in commerce or in the production of goods for commerce, wages at the rates in that subsection. Paragraph (a)(1) says, except as otherwise provided in the section, not less than the rates in subparagraphs (A), (B), and (C). Subparagraph (C) is $7.25 an hour, beginning 24 months after the 60th day after 25 May 2007. Paragraphs (a)(2), (a)(3), and (a)(4) state different measures for a home worker in Puerto Rico or the Virgin Islands, a seaman on an American vessel, and an employee employed in agriculture. Paragraph (d)(1) says no employer having employees subject to the section shall discriminate, within any establishment, between employees on the basis of sex by paying wages at a rate less than the rate paid to employees of the opposite sex for equal work on jobs requiring equal skill, effort, and responsibility and performed under similar working conditions, except for a seniority system, a merit system, a system which measures earnings by quantity or quality of production, or a differential based on any other factor other than sex. An employer who is paying a differential in violation of that subsection shall not reduce any employee's wage rate in order to comply. No joint-employer test appears on the page. The tool does not decide that the franchisor is the employer of the franchisee's workers and does not decide that a wage was underpaid. The lawyer decides exposure. State wage rules were not opened. The Cornell page is not the official edition.
