Compare a collections script with the opened false-representation prohibitions
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Quote short script lines next to the prohibition they might touch, with the page of the script. Do not rewrite the script and do not say the firm is a debt collector.
- What the lawyer must review
- 15 U.S.C. § 1692e says a debt collector may not use any false, deceptive or misleading representation or means in connection with the collection of any debt. The opened examples include a false claim of affiliation with the United States or a state, a false implication that a communication is from an attorney, a false claim that the consumer committed a crime, a false representation used to collect a debt or obtain information, and a false implication that documents are legal process. Section 1692 states the purpose of eliminating abusive debt-collection practices by debt collectors. The definition of debt collector is in § 1692a, which was not opened, so you decide whether the firm or its vendor is a debt collector before any line is treated as a violation.
