Check a concerns notice against the required content
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Against section 12A, mark whether the notice is in writing, states where the matter can be accessed, states the imputations of concern, states the serious harm the person considers the publication has caused or is likely to cause, and, if the aggrieved person is an excluded corporation, states the serious financial loss. Note whether a copy of the matter was provided or why that was not practicable.
- What the lawyer must review
- The lawyer decides whether the notice is a concerns notice, whether any element is inadequately particularised, and whether to give a further particulars notice or to treat the notice as sufficient.

Checklist
- Check location, imputations, serious harm and, for an excluded corporation, serious financial loss. A missing item is not cured by a later pleading.
- Diarise 14 days from a further particulars notice, unless a longer period is agreed.
- If reasonable further particulars are not provided in that period, treat the notice as not given for section 12A and tell the lawyer before any offer clock is calculated.
