Work out the investigation period after a Commonwealth arrest
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the arrest time and whether the arrested person is an Aboriginal person or a Torres Strait Islander, state the investigation period on the bench book and the time it would end if no extension and no dead time applied. Do not decide that the detention was lawful.
- What the lawyer must review
- The lawyer decides whether dead time applies, whether an extension was granted, and whether the person was released or brought before a judge within the period.

| Assistance | Do not begin AI assistance until the responsible lawyer has defined and confirmed its permitted scope. |
| Lawyer | Set the scope, supervise the work closely, verify every part relied on, resolve omissions and exceptions, and approve the exact output. |
Checklist
- Use two hours where the person is an Aboriginal person or a Torres Strait Islander, and four hours otherwise.
- Do not ignore dead time under section 23C(7). The lawyer identifies which intervals are dead time.
- If an extension is relied on, confirm a serious offence, one extension only, and not more than 8 hours.
