- Record whether the file contains a request for an inquest by the medical examiner and the county attorney, or by the coroner and the county attorney, and whether it contains a county-attorney subpoena. Write no application for leave to appear.
- What the lawyer must review
- Minnesota Statutes section 390.11, subdivision 5, provides that an inquest may be held at the request of the medical examiner and the county attorney, or the coroner and the county attorney. An inquest is optional, and the coroner or medical examiner may investigate and certify a death without one. The opened text does not describe an application for leave to appear, and it does not authorize a family request standing alone. When an inquest is held, the county attorney may issue subpoenas. Attendance is enforced under Minnesota Rule of Criminal Procedure 22, which was not opened. Inquest records are public, but the record and report may not be used in evidence in any civil action arising out of the death. That bar is not a rule about criminal evidence. The CDC page states that each state sets its own standards for which deaths require investigation. You do not file a leave application the statute does not describe. Opinion 512.
