- How AI is used
- From the record the lawyer has marked, list the Rule 803(6) conditions and leave each one blank: made at or near the time by, or from information transmitted by, someone with knowledge; kept in the course of a regularly conducted activity of a business, organization, occupation, or calling, whether or not for profit; making the record was a regular practice of that activity; the conditions are shown by the custodian or another qualified witness, or by a certification that complies with Rule 902(11) or (12) or a statute permitting certification; and the opponent does not show that the source or the method or circumstances of preparation indicate a lack of trustworthiness. Do not decide that the record is admissible. Do not prepare the certification.
- What the lawyer must review
- The lawyer decides whether the exception is met. Federal Rule of Evidence 803(6) is the hearsay exception for a record of an act, event, condition, opinion, or diagnosis if those five conditions are met. The certification cross-references were not opened beyond Rule 902's electronic routes, so no certification is drafted. Rule 802 still bars hearsay unless a statute, these rules, or another Supreme Court rule provides otherwise. The tool does not decide admission.
