Record that relevant evidence is admissible unless a listed source provides otherwise
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Where the lawyer has already marked the evidence as relevant, record that it is admissible unless the United States Constitution, a federal statute, these rules, or other rules prescribed by the Supreme Court provide otherwise. Record that irrelevant evidence is not admissible. Do not decide relevance. Do not decide that no other rule applies.
- What the lawyer must review
- The lawyer decides relevance and whether another source keeps the evidence out. Federal Rule of Evidence 402 is the admissibility rule. Rule 401 is the relevance test and is not reapplied here. Later rules, including Rules 403, 802, and 901, can still control. The tool does not decide admission.
