How AI is used
Where the lawyer has marked evidence as admissible against one party or for one purpose but not against another party or for another purpose, record that, on timely request, the court must restrict the evidence to its proper scope and instruct the jury accordingly. Do not decide that the evidence is admissible for any purpose. Do not draft the instruction.
What the lawyer must review
The lawyer decides the limited purpose and requests the instruction. Federal Rule of Evidence 105 requires the restriction and the instruction on timely request. Rule 403 remains available where probative value is substantially outweighed by a listed danger. The advisory note on Rule 105 discusses a limiting instruction that did not protect an accused; that note is not applied as a holding. The tool does not draft the instruction and does not decide admission.
