How AI is used
From the chart or calculation the lawyer has marked, record that the court may admit as evidence a summary, chart, or calculation offered to prove the content of voluminous admissible writings, recordings, or photographs that cannot be conveniently examined in court, whether or not those materials have been introduced. Record that the proponent must make the originals or duplicates available for examination or copying, or both, at a reasonable time and place, and that the court may order them produced in court. Record that a summary which functions only as an illustrative aid is governed by Rule 107. Do not decide that the materials are voluminous or admissible. Do not offer the summary.
What the lawyer must review
The lawyer decides whether Rule 1006 is met. The rule, as amended with effect from 1 December 2024, admits the summary as evidence of content. It does not require that the underlying materials themselves have been introduced. The proponent must make the originals or duplicates available. Rule 107 was not opened, so an illustrative aid is flagged and not described. Rule 1002 still states the requirement of the original when content is proved and no other rule provides otherwise. The tool does not decide admission.
