Screen whether the client sits outside the costs disclosure Part
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the client's constitution, company search or engagement, list the facts that go to each class in section 170(2): law practice, public company or subsidiary, large proprietary company, foreign company, liquidator, administrator or receiver, financial services licensee, joint-venture company, partnership of more than 20 members or one that would be a large proprietary company, body incorporated outside Australia, tendered costs, or government authority. Record any class added by rule 71.
- What the lawyer must review
- The lawyer decides whether the client is a commercial or government client so that the Part does not apply, and remembers that sections 181(1), (7) and (8), 182, 183 and 185(3), (4) and (5) still apply.

Checklist
- Do not skip disclosure for a small proprietary company unless a specific class in section 170(2) applies.
- Even where the Part does not apply, check the conditional-costs and uplift provisions that section 170 keeps alive.
- Check rule 71 before treating a state-owned body as outside the list in the Act.
