List any fee-dispute procedure the file identifies, and whether the file says that procedure is mandatory. Do not say the lawyer has complied.
What the lawyer must review
You decide the next step. Comment [9] to Rule 1.5 says that if a procedure has been established for resolution of fee disputes, such as an arbitration or mediation procedure established by the bar, the lawyer must comply with the procedure when it is mandatory, and, even when it is voluntary, the lawyer should conscientiously consider submitting to it. The comment also says that law may prescribe a procedure for determining a lawyer's fee, for example in representation of an executor or administrator, a class, or a person entitled to a reasonable fee as part of the measure of damages, and that the lawyer should comply with the prescribed procedure. Rule 1.5(a) remains the rule against an unreasonable fee or unreasonable expenses. These pages do not list national avenues that must be printed on a bill, and they state no time limit for starting a fee dispute. The tool does not choose the forum and does not say the procedure was followed.
