How AI is used
From the tool's send list, name each person who would receive information relating to the representation, and whether the file shows informed consent or that the disclosure is impliedly authorized. Do not send the information.
What the lawyer must review
Model Rule 1.6(a) forbids the revelation unless the client gives informed consent, the disclosure is impliedly authorized to carry out the representation, or paragraph (b) permits it. Rule 1.6(c) requires reasonable efforts against unauthorized access. Formal Opinion 512 says the lawyer must also consider people inside the firm who would not protect the information, including because they do not know it came from a client. The lawyer decides whether anyone on the list may receive it.
