How to use AI for patent drafting in Australia

A patent attorney can use a tool to prepare a draft. An artificial intelligence system is not named as the inventor. The specification stays confidential until filing, and the attorney settles the claims.

Steps

  1. Do not name an AI system as inventor

IP Australia’s position, recorded on its AI inventions material, is that an artificial intelligence system cannot be named as the inventor. The inventor is a natural person. A draft that puts the model in the inventor field is wrong. Open IP Australia’s page before you complete the request.

  2. Keep the invention confidential before filing

A prompt that contains the inventive concept, sent to a public tool, can be a disclosure. Use a tenancy whose terms you have read, or do not upload the draft at all. The hosting guide is the vocabulary for that conversation. Filing strategy is the attorney’s, not the model’s.

  3. The attorney settles the claims

Claims, support, and the distinction over the prior art are settled by the attorney who signs the work. A fluent independent claim is not a finished claim. If the client will be told a tool was used, say what it drafted and what the attorney changed.
