Guide to publishing a notice of intended distribution on the NSW Online Registry under s 92 of the Probate and Administration Act and s 93 of the Succession Act, with the timing rules, the limits of the protection, and an executor's distribution diary.

## Key facts

- Kind: Notice. A formal notice to serve or publish.
- Practice area: [Wills, Estates, Probate & Succession](https://ailawframework.com/precedents/wills-estates-probate-and-succession.md)
- Jurisdictions: New South Wales
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the official form at supremecourt.nsw.gov.au and the 5 authorities it cites, for New South Wales.

## When to use it

Use after a NSW grant when the executor or administrator wants protection before distributing. Publication is not mandatory, but distributing without it (or too early) increases personal risk if a creditor or family provision claim emerges.

## How AI may be used

AI may calculate and diary the key dates and draft the estate distribution checklist, under supervision. The notice itself is published through the Online Registry in the approved form, and the decision to distribute is the executor's on the lawyer's advice.

**AI may:**

- Calculate the 6-month, notice-expiry and 12-month dates from the date of death and notice date, for checking
- Draft the distribution checklist and letters to beneficiaries from the estate ledger

**AI must not:**

- Must not draft or publish the notice text (the Online Registry uses the approved wording)
- Must not advise whether it is safe to distribute

**The lawyer checks:**

- Dates calculated correctly and entered in the firm's diary
- No notice of any claim or intended claim received before distribution
- Advice to the executor on the remaining notional estate risk
