A deed recording the retirement or replacement of the appointor (and, if the deed has one, the guardian) of a discretionary trust under the power in the trust deed, with recitals proving the power, succession provisions, and a check that the change is within the deed's power.

## Key facts

- Kind: Deed. A deed that must be executed as a deed.
- Practice area: [Trusts & Estate Planning](https://ailawframework.com/precedents/trusts-and-estate-planning.md)
- Jurisdictions: Australia
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 2 authorities it cites, for Australia.

## When to use it

Use when control of a family trust is to pass to a new appointor, for example on retirement, incapacity, divorce or succession planning, or when an appointor has died and the deed names how a successor is chosen. If the deed has no power to change the appointor, the change may need a variation under the amendment power or a court application.

## How AI may be used

AI may extract the appointor, guardian and succession clauses and the history of changes from the deed and variations and fill the deed; a lawyer decides whether the deed permits the change in this way and what the estate planning effect is.

**AI may:**

- Extract every clause about the appointor, guardian, their succession and the trustee's amendment power from the deed and all variations
- Build a chain of every past change of appointor and guardian with the document for each
- Fill the deed's recitals and parties from that chain

**AI must not:**

- Must not decide that the power to change the appointor exists or has been validly exercised in the past
- Must not use the amendment power to change the appointor without the lawyer's analysis of its scope
- Must not advise on the tax, duty or family law consequences of the change

**The lawyer checks:**

- The deed (as varied) gives the power used, the person exercising it holds it, and any formality (deed, writing, consent, notice to trustee) is met
- The chain of appointors and guardians since establishment is complete and each earlier change was valid
- The change does not alter beneficial interests or otherwise go beyond the power, so the trust continues (TD 2012/21)
- Consistency with the clients' wills, enduring powers of attorney and succession plan, including what happens on death or incapacity

## Authorities

- [ATO, Taxation Determination TD 2012/21 (changes to a trust made by a valid exercise of a power in the deed: the trust continues unless it terminates for trust law purposes; whether a change is supported by the power is a question of trust law, paras 1 and 26)](https://www.ato.gov.au/law/view/document?docid=TXD/TD201221/NAT/ATO/00001)
- [Trustee Act 1925 (NSW) s 6(4)(a) (appointment of new trustees by the person nominated for that purpose by the trust instrument)](https://legislation.nsw.gov.au/view/whole/html/inforce/current/act-1925-014)
