Participant form for clubs and operators of recreational activities: specific risk warning, health declaration, exclusion of consumer guarantees for personal injury within CCA s 139A, release, and parent sections for minors, drafted to the NSW Civil Liability Act.

## Key facts

- Practice area: [Sports & Entertainment Law](https://ailawframework.com/precedents/sports-and-entertainment-law.md)
- Jurisdictions: New South Wales, Victoria, Australia
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the 6 authorities it cites, for New South Wales, Victoria and Australia.

## When to use it

Use for NSW recreational activities supplied to consumers, such as adventure sports, fitness classes, events and club competition. Enforceability turns on state law: in Victoria the prescribed warning must be used, and other states differ, so do not generalise the NSW form.

## How AI may be used

AI can draft the activity-specific risk list from the operator's risk assessment, but enforceability turns on state-specific civil liability rules and CCA s 139A, so AI must not generalise a NSW form to other states.

**AI may:**

- List the specific risks of the activity from the operator's risk assessment and incident history.
- Check readability so the warning is clear to a typical participant.
- Compare an operator's existing form with this precedent and list gaps.

**AI must not:**

- Must not adapt the form for another state without the lawyer checking that state's law.
- Must not remove or soften the risk warnings to make the form more marketable.
- Must not be given participants' health declarations in a tool not approved for health information.

**The lawyer checks:**

- The form is presented and signed before the participant pays or participates, or the terms are otherwise brought to their attention in time.
- The exclusion is limited to death and personal injury and does not purport to cover reckless conduct.
- In Victoria, the exact prescribed warning is used.
- The operator's safety systems and legal safety requirements are actually followed.
