An artist management agreement between a performer and a manager: services, commission and post-term commission, trust handling of the artist's money, accounting, key person and termination, with the NSW managerial agreement, cooling-off and capped-fee rules built in.

## Key facts

- Kind: Agreement. A contract between two or more parties.
- Practice area: [Sports & Entertainment Law](https://ailawframework.com/precedents/sports-and-entertainment-law.md)
- Jurisdictions: New South Wales, Australia
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 4 authorities it cites, for New South Wales and Australia.

## When to use it

Use when a musician, actor or other performer appoints a personal manager for career and business management. In NSW the Entertainment Industry Act 2013 applies to performer representatives and fixes trust, fee and cooling-off rules. For a booking agent only, or for a record, publishing or production deal, use a different precedent.

## Used for these tasks

- [Draft a talent or artist-management agreement](https://ailawframework.com/practice/sports-and-entertainment-law.md#A39-T1-R8)

## How AI may be used

AI may assemble the agreement and commission schedule from the agreed terms; a lawyer checks the fee structure against the capped amount and managerial agreement rules, the cooling-off steps and the post-term commission before the performer signs.

**AI may:**

- Fill the parties, term, territory, commission rates and excluded income from the agreed term sheet
- Produce a worked commission example from figures the lawyer supplies, for the explanatory schedule
- Check the draft for every defined term and cross-reference and list inconsistencies

**AI must not:**

- Must not decide whether the manager is a class 1 or class 2 performer representative, or whether the fees exceed the capped amount
- Must not state the prescribed percentage or the prescribed information from memory; they must come from the current regulation
- Must not prepare the cooling-off notice, waiver or prescribed information in any form other than the one approved under the Act
- Must not advise the performer on whether the deal is fair; the performer needs independent advice

**The lawyer checks:**

- Current Entertainment Industry Regulation checked for the capped percentage, the prescribed information and the approved forms
- If commission exceeds the capped amount, the agreement is in writing, fixes the fees, contains the additional fee acknowledgement and the s 13 information was given first
- Trust account details and the payment timetable for the performer's money comply with s 6 and the regulation
- Post-term commission, key person and termination rights have been explained to the performer, who has been told to get independent advice
