A checklist for building or reviewing the medical evidence for a Disability Support Pension claim or review: which Tables apply, whether each condition is diagnosed, reasonably treated and stabilised and likely to persist, the specialist evidence some Tables need, and the 20-point rule.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Social Security & Veterans' Entitlements](https://ailawframework.com/precedents/social-security-and-veterans-entitlements.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 3 authorities it cites, for Australia and Commonwealth.

## When to use it

Use when preparing a DSP claim, a request for review of a rejection, or a tribunal review, to test the evidence for each condition against the 2023 Impairment Tables (or the 2011 Tables for claims lodged before 1 April 2023).

## Used for these tasks

## How AI may be used

AI may map each report to the conditions and Tables and list gaps in diagnosis, treatment, stability and duration evidence; the lawyer or advocate decides which Tables apply, what the evidence shows and what further evidence to seek.

**AI may:**

- List each condition, its diagnosing practitioner and date, and the treatment history, from the medical records
- Map each report to the Table that assesses the affected function, and flag missing specialist evidence the Table requires
- Build a gaps list for the treating practitioner letters

**AI must not:**

- Must not assign or predict an impairment rating or points
- Must not decide whether a condition is reasonably treated or stabilised
- Must not describe the client's symptoms or function beyond what the medical evidence and the client say

**The lawyer checks:**

- The right Tables are used for the claim date (2023 Tables for claims, reviews or appeals of claims lodged on or after 1 April 2023)
- Each condition has a diagnosis by an appropriately qualified practitioner with the corroborating evidence the Table requires
- The evidence addresses treatment tried, treatment planned in the next 2 years and its likely effect, stability and the likelihood of persisting for more than 2 years
- Whether the client needs 20 points on one Table, or 20 points across Tables plus the Program of Support rules, and whether a manifest medical rule may apply
