Advice-led letter asking Services Australia to waive all or part of a social security debt under the Social Security Act 1991 (special circumstances under s 1237AAD, sole administrative error under s 1237A) or, in the alternative, to write it off under s 1236.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Social Security & Veterans' Entitlements](https://ailawframework.com/precedents/social-security-and-veterans-entitlements.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Red. Keep AI out of the decisive steps. A lawyer does the work.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 3 authorities it cites, for Australia and Commonwealth.

## When to use it

Use after the debt itself has been checked (and, if wrong, challenged) and the client's circumstances may make recovery inequitable, for example family and domestic violence, serious illness, addiction or an error by the agency. Can be made at the same time as, or as a ground in, a formal review of the debt.

## How AI may be used

The advocate writes the waiver argument; AI may assemble the chronology, the debt figures and the evidence index, and check that the letter's facts match the documents.

**AI may:**

- Build a chronology of the debt period, the client's circumstances and contact with Centrelink from the records
- Tabulate the debt by period and payment type from the debt schedule, for the advocate to check
- Index medical, support-service and other evidence of the client's circumstances

**AI must not:**

- Must not write the argument that special circumstances exist or that the debt is attributable solely to administrative error
- Must not describe family violence, health or addiction in more detail than the client has agreed to disclose
- Must not state that the client did not knowingly make a false statement unless the advocate has confirmed it with the client

**The lawyer checks:**

- The debt has been checked first: existence, period, amount and calculation
- Which waiver ground fits the facts, including the false-statement and non-compliance conditions the special circumstances waiver requires, and whether write-off is the better request
- The client consents to each sensitive matter disclosed and to the supporting evidence being given to the agency
