# Victorian notice to vacate validity checklist

> A checklist for a Victorian notice to vacate: the form of the notice, reasons the page says cannot be used, and the evidence each end-of-agreement ground requires. It does not conclude that the ground is made out.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Residential Tenancies](https://ailawframework.com/precedents/residential-tenancies.md)
- Jurisdictions: Victoria
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 2 authorities it cites, for Victoria.

## When to use it

Use when checking a Victorian rental provider's notice to vacate, or when assembling the evidence for a sale, repair, demolition, business-use or move-in ground. Do not use it as the notice, or as advice that a ground is available. The official Word notice is lodged or given, not this checklist.

## How AI may be used

AI may mark which rows the notice and the documents appear to meet, and list what is missing. The lawyer decides whether the ground is available and whether the notice is valid.

**AI may:**

- Compare the notice with the five form requirements and the three delivery methods
- Flag a reason the page says cannot be used, including a notice for requesting repairs, asking for a pet, challenging a rent increase, or unlawful discrimination
- List the evidence the page requires for the ground named on the notice, and note any document that is not on the file
- Record whether a no-reason notice is being used at the end of the first fixed term or a later term

**AI must not:**

- Must not advise that the rental provider may end the agreement, or that the notice is valid
- Must not draft the notice, a statutory declaration, or a witness statement
- Must not treat the page's examples of evidence as satisfied because a document has a similar name
- Must not describe mortgagee notice periods, or the rules on the immediate-notice page that was not opened

**The lawyer checks:**

- The reason on the notice is one the page lists, and any required evidence is actually attached
- A no-reason notice is used only at the end of the first fixed term
- The sale ground has not been created by shortening the agreement, and the contract or authority is one of the three documents the page names
- A notice given after a repair request, a pet request, a rent challenge, or an allegation of discrimination is not treated as valid on the papers alone
