A checklist for a Victorian VCAT application to change or end a rental agreement because of family violence. It lists the orders and the kinds of evidence the page names. It does not contain anyone's account of the violence.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Residential Tenancies](https://ailawframework.com/precedents/residential-tenancies.md)
- Jurisdictions: Victoria
- AI level: Red. You write the text. The tool writes nothing into the document. Where permitted, it may check, clarify or collect data, and anything it checks or collects is verified.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 2 authorities it cites, for Victoria.

## When to use it

Use when a person is preparing a Victorian VCAT application to take a new agreement without the violent person, or to leave early without break-lease compensation, or when a rental provider has received that application. Do not use it as the application, a witness statement, or a statutory declaration.

## Used for these tasks

## How AI may be used

AI may list document references against the evidence categories the page names. It must not write the person's account, a child's account, or any sentence that will be filed or said at VCAT.

**AI may:**

- List which of the two orders is being asked for, in the lawyer's words, as a heading only
- Index documents already on the file against the categories the page lists, by document type and date
- Diary the hearing as within 3 business days, or the next available day after those 3 business days
- Note, for a provider, the condition-report, inspection, bond and lock points the page states

**AI must not:**

- Must not write what happened, a chronology, or a child's circumstances
- Must not draft the VCAT application, a statement, an affidavit, or submissions
- Must not decide that family violence occurred, or that an order should be made
- Must not put a person's or a child's name into an unapproved tool in order to generate the story

**The lawyer checks:**

- Nothing in the working papers is a draft of the evidence. The index is document references only
- The applicant's standing is checked: the page says a person can apply even if they are not on the agreement, and a parent or guardian can apply for children they live with
- The hearing date is taken from VCAT once allocated, not calculated as a promise
- A provider who changes locks does not give a key to the excluded person, and the excluded person may have a representative at an inspection
