## When to use it

Use when acting for a tenant who has received a termination notice, or for a landlord before one is given, for a residential tenancy agreement in NSW. It covers the grounds in ss 84 to 88 of the Residential Tenancies Act 2010 (NSW) as amended in 2024. Check the regulations for the supporting documents each ground needs.

## How AI may be used

AI may extract the notice details and calculate the minimum termination date for the ground and agreement type; the lawyer decides whether the ground is made out and the notice is valid.

**AI may:**

- Extract the premises, dates, ground, signature and attachments from the notice and the agreement into the checklist
- Calculate the earliest valid termination date for the ground and the agreement type, for the lawyer to confirm
- Compare the rent ledger with a non-payment notice to show whether rent was unpaid for at least 14 days before the notice

**AI must not:**

- Must not decide whether a ground is genuine or made out
- Must not tell the tenant or landlord that a notice is valid or invalid
- Must not contact the other party or the agent

**The lawyer checks:**

- The agreement type (periodic, short fixed term of 6 months or less, or other fixed term) is right, and the termination date meets the minimum period and, for a fixed term, falls on or after the end of the term where the ground requires it
- The notice is in writing, signed, identifies the premises and the termination date, states the ground, and includes the supporting documents the regulations require
- For a non-payment notice, the rent had been unpaid for at least 14 days when the notice was given
- The tenant has not been in continual possession for 20 years or more, unless the ground is breach or actual sale
